These Terms and Conditions set out the basis on which Waste Collection Harringay provides waste collection and related services to residential and commercial customers within Harringay and surrounding areas. By booking a service, you agree to be bound by these Terms and Conditions. Please read them carefully before making a booking.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings given below:

Customer means the individual, business, organisation, or other entity booking or receiving waste collection services.

We, Us, Our means Waste Collection Harringay as the provider of waste collection services.

Services means any waste collection, clearance, removal, transportation, or related services provided by us.

Waste means any materials or items to be collected by us, including household waste, commercial waste, bulky items and recyclable materials, in accordance with these Terms and Conditions and applicable regulations.

2. Scope of Services

We provide waste collection and related services within Harringay and nearby areas, subject to operational constraints, access, and compliance with applicable waste regulations. The precise nature of the service, including the type and volume of waste to be collected, the location, and the collection date and time, will be agreed at the time of booking.

We reserve the right to refuse to collect any waste that is hazardous, illegal, incorrectly described, improperly packaged, or which in our reasonable opinion poses a risk to health, safety, the environment, or our staff or contractors.

3. Booking Process

3.1 Bookings may be made by telephone, email, online form, or any other method we make available from time to time. By submitting a booking request, you confirm that all information provided is true, accurate, and complete.

3.2 When you request a booking, we will provide an estimated price and a provisional time window for collection, based on the information supplied. A booking is not confirmed until we have accepted it and provided you with a confirmation, which may be sent by email, text message, or other written communication.

3.3 You are responsible for providing full and accurate details of the collection address, access arrangements, parking conditions, type and approximate volume of waste, and any other relevant information. Failure to do so may result in additional charges, delays, or cancellation of the service.

3.4 Where the service requires access to private property, shared areas, gated premises, or restricted zones, you must ensure that appropriate access arrangements are in place for the agreed collection time. If we cannot access the site, we may charge a call-out or wasted journey fee.

4. Service Times and Access

4.1 We will use reasonable efforts to attend the property within the agreed time window. However, all collection times are estimates and are subject to traffic, weather, operational constraints, and other circumstances beyond our reasonable control. Time is not of the essence for the provision of our services.

4.2 You must ensure that the waste is ready for collection at the agreed time and that there is safe and unobstructed access for our staff and vehicles. This includes ensuring that any driveways, entrances, and approach roads are accessible and that any necessary permissions for parking or loading are obtained in advance.

4.3 If we are unable to complete the collection due to lack of access, unsafe conditions, or incorrect information provided by you, we may at our discretion either reschedule the collection and charge a reasonable additional fee or treat the visit as a completed service and charge accordingly.

5. Description and Presentation of Waste

5.1 You must accurately describe the waste to be collected at the time of booking, including its type, estimated volume, and any special characteristics. The price quoted will be based on this description.

5.2 On arrival, our staff will assess the waste. If the actual volume or type of waste differs from that described at booking, we may revise the price. If you do not accept the revised price, we reserve the right not to proceed with the collection and to charge a reasonable call-out fee.

5.3 All waste must be presented in a manner that is safe and suitable for collection. This includes bagging loose waste where appropriate, separating recyclable materials when requested, and ensuring that items are not contaminated with hazardous substances.

5.4 We will not collect any waste classified as hazardous or special waste under applicable law, including but not limited to asbestos, certain chemicals, clinical or medical waste, corrosive substances, or pressurised containers, unless we have expressly agreed in writing to do so and specific arrangements have been made.

6. Pricing and Payment

6.1 Unless otherwise stated, all prices are quoted in pounds sterling and are exclusive of any applicable taxes or charges that may be imposed by law. Any such amounts will be added to the price where applicable.

6.2 Prices may be based on factors including the type and volume of waste, the number of items, labour time, access conditions, disposal costs, and distance travelled. We reserve the right to amend our prices at any time, but changes will not affect confirmed bookings that have already been accepted by us, except where the booking details were inaccurate or incomplete.

6.3 Payment is due in accordance with the terms provided at booking. For most residential services, payment is required on completion of the collection or in advance. For commercial customers, we may agree alternative payment terms subject to credit checks and approval.

6.4 Payment may be made by cash, card, bank transfer, or other methods we may accept from time to time. We are not obliged to provide the service until cleared funds have been received where payment is required in advance.

6.5 If payment is not made when due, we may charge interest on overdue amounts at the statutory rate and may suspend further services until all outstanding sums have been paid in full.

7. Cancellations and Amendments

7.1 You may cancel or amend a booking by contacting us using the details provided at the time of booking. Any cancellation or amendment must be received within a reasonable time before the scheduled collection.

7.2 For standard residential collections, if you cancel at least 24 hours before the scheduled collection time, no cancellation fee will normally be charged. If you cancel within 24 hours of the scheduled collection, we may charge a reasonable cancellation fee to cover administrative and operational costs.

7.3 For commercial services, large collections, or services requiring special equipment or permits, different cancellation terms may apply as notified at the time of booking. Short-notice cancellations may incur additional charges.

7.4 We reserve the right to cancel or reschedule any booking due to circumstances beyond our control, including severe weather, vehicle breakdown, staff illness, or regulatory restrictions. In such cases, we will offer an alternative date or a refund of any sums paid for services not provided, but we will not be liable for any indirect or consequential losses resulting from the cancellation.

8. Customer Obligations

8.1 You are responsible for ensuring that you have the legal right to request the removal of the waste from the property and that our access and activities will not breach any lease, tenancy, title, or other agreement.

8.2 You must provide a safe working environment for our staff and contractors, including ensuring that the site is free from hazards, that animals are controlled, and that waste is not stored in a manner that poses a risk of injury or damage.

8.3 You must not request the collection of any waste that you know or suspect to be illegal to dispose of through normal waste channels. If we believe that any waste is illegal or improperly described, we may suspend the service and report the matter to the appropriate authorities.

9. Waste Handling and Environmental Compliance

9.1 We will handle, transport, and dispose of waste in accordance with applicable UK waste management laws, regulations, and codes of practice. This includes complying with duty of care obligations and using authorised waste transfer and disposal facilities.

9.2 Where required by law, we will complete waste transfer documentation and retain records for the required period. You agree to provide any information reasonably necessary to complete such documentation accurately.

9.3 We aim to maximise reuse and recycling where practicable. However, we do not guarantee that any particular item will be recycled, reused, or diverted from landfill unless expressly agreed in writing.

10. Limitation of Liability

10.1 Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded under applicable law.

10.2 Subject to the above, our total liability to you arising out of or in connection with any single service, whether in contract, tort, negligence, or otherwise, shall be limited to the total price paid or payable by you for that service.

10.3 We will not be liable for any loss of profits, loss of business, loss of reputation, or any indirect or consequential loss arising out of or in connection with our services, even if we have been advised of the possibility of such loss.

10.4 You must notify us in writing of any damage, loss, or issue arising from our services as soon as reasonably practicable and in any event within 7 days of the collection. We may require evidence, such as photographs or access to inspect the property, before considering any claim.

11. Property and Damage

11.1 We will take reasonable care when carrying out collections on your property. However, you acknowledge that the movement of heavy items, bulky waste, or vehicles may carry a risk of minor damage, particularly where access is restricted.

11.2 You are responsible for protecting any surfaces, fixtures, fittings, or items that may be vulnerable to damage during the collection. This includes pavements, driveways, lawns, gates, and internal areas through which items may need to be moved.

11.3 We will not be liable for damage to driveways, access roads, or surfaces where you have requested or consented to our vehicles or staff entering such areas, unless the damage is caused by our negligence and was reasonably foreseeable.

12. Insurance

12.1 We maintain appropriate public liability and employer liability insurance in connection with the provision of our services. Details of cover can be made available upon reasonable request.

13. Data Protection and Privacy

13.1 We will collect and process personal information about you in connection with your booking and the provision of our services. This may include your name, contact details, payment information, and service history.

13.2 We will handle your personal data in accordance with applicable data protection legislation and only use it for purposes related to managing your bookings, providing services, processing payments, and fulfilling our legal obligations.

14. Complaints

14.1 If you are dissatisfied with any aspect of our service, you should contact us as soon as possible with full details of the issue. We will investigate and aim to respond within a reasonable timeframe.

14.2 Making a complaint does not affect your statutory rights.

15. Changes to these Terms

15.1 We may update or amend these Terms and Conditions from time to time. The version in force at the time of your booking will apply to that service. Any new version will apply to subsequent bookings.

16. Governing Law and Jurisdiction

16.1 These Terms and Conditions and any dispute or claim arising out of or in connection with them or the services shall be governed by and construed in accordance with the laws of England and Wales.

16.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter.

17. General Provisions

17.1 If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid or unenforceable, that provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable, and the remaining provisions shall remain in full force and effect.

17.2 No failure or delay by us in exercising any right or remedy under these Terms and Conditions shall constitute a waiver of that or any other right or remedy.

17.3 You may not assign or transfer your rights or obligations under these Terms and Conditions without our prior written consent. We may assign or transfer our rights and obligations to another organisation as part of our business operations, provided that this does not affect your statutory rights.
